1. Acceptance of Terms

By accessing or using TattooQueue, a product of EchosOfMe LLC ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

TattooQueue is a queue management and booking platform for tattoo studios. Our Service includes walk-in queue management, style-based artist matching, digital waivers, SMS notifications, online booking, and analytics tools.

3. User Accounts

Account Creation

To use certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

Account Types

Studio Owners: Can create and manage studios, invite artists, configure settings, and access analytics.
Artists: Can manage their profiles, claim clients, and handle bookings.
Clients: Can join queues and submit booking requests without an account.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Impersonate any person or entity
Interfere with or disrupt the Service or servers
Attempt to gain unauthorized access to any part of the Service
Use automated systems to access the Service without permission
Transmit any malicious code or harmful content
Collect user information without consent
Use the Service to send unsolicited communications

5. Studio Owner Responsibilities

Studio owners are responsible for:

Ensuring compliance with local laws and regulations regarding tattoo services
Managing artist accounts and access permissions
Configuring appropriate waiver content for their jurisdiction
Obtaining proper consent from clients for SMS communications
Maintaining accurate studio and artist information

6. SMS/Text Messaging Terms

By checking the SMS consent checkbox and providing your phone number on a TattooQueue studio queue sign-up form or online booking form, you expressly consent to receive automated, transactional SMS text messages from TattooQueue on behalf of the participating tattoo studio.

Message types: Queue status updates (e.g., "your artist is ready"), wait time estimates, appointment confirmations, appointment reminders (24-hour and 2-hour), and booking status changes. Messages are transactional only — no marketing or promotional messages are ever sent.

Message frequency: Varies based on usage, typically 1–5 messages per visit or booking.

Message and data rates may apply. Check with your mobile carrier for details about your messaging plan.

Opt-out: You may opt out at any time by replying STOP to any message. After opting out, you will not receive any further SMS messages from TattooQueue.
Help: Reply HELP for assistance.

Consent is never pre-checked. The SMS consent checkbox is always unchecked by default. The phone number input field only appears after you actively check the consent box. You are never required to consent to SMS messaging as a condition of service.

Your mobile phone number, SMS consent, and opt-in data will never be shared with or sold to third parties or affiliates for marketing or promotional purposes. Mobile information is used solely for the purpose of sending the transactional messages described above.

7. Digital Waivers

TattooQueue provides digital waiver functionality as a convenience tool. Studios are solely responsible for the content, legal validity, and compliance of their waivers. We do not provide legal advice and recommend consulting with a legal professional regarding waiver requirements.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by TattooQueue and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of content you upload (such as portfolio images and waiver content).

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TATTOOQUEUE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless TattooQueue and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account at any time for violations of these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
